Terms of Service

These Terms are a binding agreement between you and Alt Horizon Games LLC (“ChudGames”, “we”, “us”), covering your use of chudgames.org and the games served from it (the “Service”).

By using the Service you agree to these Terms. If you do not agree, do not use the Service.

1. Who may use the Service

You must be 13 or older. If you are under the age of majority where you live, you may use the Service only with a parent or guardian’s involvement, and they accept these Terms on your behalf.

Some games are rated 16+ based on their content descriptors — the strictest rating we issue. You must meet the rating shown on a game’s page to play it.

You may not use the Service if we have previously terminated your account, or if you are barred from receiving services under applicable export control or sanctions laws.

2. Your account

You do not need an account to play. An account lets you save progress, submit scores and keep favourites.

We sign you in with a one-time code sent to your email address. There is no password. Keep access to your email secure — anyone who can read your email can sign in as you. You are responsible for activity under your account.

Tell us promptly at security@chudgames.org if you believe your account has been accessed without your permission.

3. Acceptable use

You agree not to:

  • upload, submit or transmit content that is unlawful, or that violates our Content Policy;
  • attempt to gain unauthorised access to the Service, other users’ accounts, or any system or network connected to the Service;
  • probe, scan or test the vulnerability of the Service except as permitted in section 10;
  • interfere with or disrupt the Service, including by overwhelming it with requests;
  • circumvent, disable or interfere with security or content-rating features, including age gates and regional restrictions;
  • falsify scores, gameplay results, ad interactions or any other measured activity, or use bots, automation or modified clients to do so;
  • scrape, crawl or harvest data from the Service except as permitted by our robots.txt;
  • use the Service to distribute malware, or to phish or defraud anyone;
  • resell, sublicense or commercially exploit the Service without our written permission.

4. Games and user content

Games on the Service may be developed by us or, in future, by third-party developers. Games run in a sandboxed browser environment isolated from your ChudGames account. A game cannot read your sign-in session.

Every game is reviewed by a human and given content descriptors and an age rating before it is publicly visible. We may remove or restrict any game at any time, including immediately and without notice where we believe it is unlawful or presents a risk to users.

We do not guarantee that any game is accurate, available, uninterrupted, or free of defects.

Reporting content

Use the report control on any game’s page, or email abuse@chudgames.org. Reports are reviewed by a human. Abusing the reporting system is itself a violation of these Terms.

We respond to notices of alleged infringement under the Digital Millennium Copyright Act. See our DMCA policy for how to send a notice or counter-notice, and details of our designated agent. We terminate the accounts of repeat infringers.

5. Your content and licence

If you submit anything to the Service — a game, a report, a comment to a moderator — you keep ownership of it.

You grant us a worldwide, non-exclusive, royalty-free licence to host, store, reproduce, adapt (for technical formatting), publish, publicly perform and display that content for the purpose of operating and promoting the Service. For games, this licence continues while the game is published and for a reasonable period afterwards to allow for backups and legal records.

You represent that you have the rights to grant that licence, and that your content does not infringe anyone else’s rights or violate any law.

Developer submissions are additionally governed by the Developer Agreement.

6. Advertising

The Service is funded by advertising. We show ads supplied by third-party ad networks. Ads appear on our own pages, outside the game frame — a game never supplies its own ad code.

Some games may offer a reward for watching an ad. Rewards are cosmetic or convenience items only. They have no monetary value, cannot be bought, sold, transferred or exchanged for money, and we may cap, change or withdraw them at any time.

We do not guarantee that ads are available, appropriate to you, or that any reward will be granted. Attempting to falsify ad interactions is a violation of section 3.

7. Availability, changes and termination

We may change, suspend or discontinue any part of the Service at any time. We may impose limits on features or restrict access without notice.

You may stop using the Service at any time, and delete your account and data from your account page.

We may suspend or terminate your access if you breach these Terms, if we are required to by law, or if we reasonably believe it is necessary to protect the Service or other users. Where practical and lawful we will tell you why.

Sections 5, 8, 9, 11 and 12 survive termination.

8. Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE”, WITHOUT WARRANTY OF ANY KIND. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.

We do not warrant that the Service will be uninterrupted, secure, or error-free, that defects will be corrected, or that any content is accurate or reliable.

Some jurisdictions do not allow the exclusion of certain warranties, so some of these exclusions may not apply to you.

9. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, WE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES, or for any loss of profits, revenue, data, goodwill or other intangible losses, arising out of or relating to your use of the Service, whether based in contract, tort, strict liability or otherwise, and whether or not we have been advised of the possibility of such damages.

Our total liability to you for all claims relating to the Service will not exceed the greater of (a) the amount you paid us in the twelve months before the claim, or (b) one hundred US dollars (US$100). The Service is free to use, so for most users this is US$100.

Some jurisdictions do not allow these limitations, so they may not apply to you.

10. Security research

We welcome good-faith security research. If you follow these rules we will not pursue legal action against you for it:

  • do not access, modify or delete data that is not yours;
  • do not degrade the Service for others — no denial-of-service, no automated high-volume testing;
  • do not use social engineering, physical attacks, or attacks against our staff or vendors;
  • give us reasonable time to fix an issue before disclosing it publicly.

11. Governing law and disputes

These Terms are governed by the laws of the State of Louisiana, United States, without regard to its conflict-of-laws rules.

Informal resolution first. Before filing a claim, you agree to contact us at legal@chudgames.org and try in good faith to resolve the dispute for at least 60 days.

Any dispute not resolved informally will be brought exclusively in the state or federal courts located in Louisiana, and you and we consent to personal jurisdiction there.

You and we each waive any right to a jury trial, and agree that claims may only be brought in an individual capacity, and not as a plaintiff or class member in any class or representative proceeding.

⚠ This section allocates significant legal rights and must be reviewed by counsel before publication. Whether to require arbitration instead of litigation, and whether a class-action waiver is enforceable and desirable, are decisions for a lawyer familiar with your jurisdiction and risk tolerance.

12. General

Entire agreement. These Terms, the Content Policy, the Privacy Policy and any policies referenced in them are the entire agreement between you and us about the Service.

Severability. If any provision is found unenforceable, the rest remains in effect.

No waiver. Our failure to enforce a provision is not a waiver of it.

Assignment. You may not assign these Terms. We may assign them in connection with a merger, acquisition or sale of assets.

Changes. We may update these Terms. If a change is material we will give notice on the site before it takes effect and update the date at the top. Continuing to use the Service after a change means you accept it.
